Labour Court dismisses Siobhan McNally’s appeal against Rotunda Hospital

Place: no local area assigned from the source.

The Labour Court dismissed Siobhan McNally’s appeal against Rotunda Hospital on a preliminary jurisdictional ground and upheld the earlier decision. The determination was signed on 30 September 2024. The complaint alleged disability discrimination over employment conditions after her employment had ended. The hospital argued that the Employment Equality Act did not cover a claim about conditions after employment ceased. The Court accepted that submission, relying on earlier findings that McNally’s employment ended on 20 May 2019. The alleged discrimination was said to have occurred on 30 November 2020. The merits of the discrimination allegation were not decided. When invited to address the hospital’s jurisdictional argument, McNally instead challenged the circumstances of her termination.
