Labour Court rejects Peter Doody’s appeal over Transdev’s compulsory retirement age

The Labour Court rejected Peter Doody’s appeal over his compulsory retirement at 65 from his tram driver job with Transdev Dublin Light Rail Limited. The Court’s determination, dated 12 January 2024, held that an earlier ruling had established the retirement age as objectively justified for the employer’s tram drivers, preventing Doody from challenging his retirement again.

Doody disputed that the earlier ruling barred his age discrimination claim. The Court applied res judicata, a rule that prevents an issue already decided from being litigated again, and found that the earlier decision covered the retirement policy for Transdev’s tram drivers generally.
