The Labour Court upheld the rejection of Christopher Sciberras’s age and race discrimination complaints against United Parcel Service Ireland Ltd after he appealed an Adjudication Officer’s decision. The determination was dated 19 November 2018.

Sciberras said he was unsuccessful in several job applications and alleged that age and nationality affected the decisions. The company denied discrimination, saying his CV did not state his age or nationality and that its workforce included people of a range of ages and nationalities.

The Court found that Sciberras did not dispute that his CV omitted his age and nationality, and gave no other basis for the company to know either. It found that he had not made a prima facie case on either ground, so his appeal failed.
