The Labour Court disallowed Mindauskas Baksatis’s appeal and affirmed the Equality Officer’s finding that Howley Civil Engineering Limited had not discriminated against him on race grounds. The determination was dated 14 December 2010.
Baksatis, a Lithuanian national who worked as a rigid truck driver, alleged discrimination in access to employment, working conditions, training, harassment and dismissal. He said other drivers were rehired after a period without work but he was not, and that pressure to increase output and limits on breaks amounted to harassment. The company was in liquidation and could not defend the proceedings.
The Court found that he had not established facts from which discrimination could be inferred. It said his nationality and dismissal, other employment-rights claims and a separate worker’s harassment case did not establish such facts.
