The Labour Court recommended that Heatons Limited apply premium rates to a worker’s rest-day work from the date she lodged her claim. The recommendation was signed on 14 December 2010. The worker, represented by Mandate, said she worked more than 37.5 hours and six days in seven without the rest-day premium provided for under the retail sector Registered Employment Agreement. The employer said her overall pay and conditions exceeded the agreement. The Court said the agreement provided premium pay for rest-day work and saw no reason to apply its clauses together rather than separately. It recommended that the company apply the premium rates to rest days worked since the claim was lodged.
