Labour Court disallows Edwin Healy’s age discrimination appeal

The Labour Court disallowed Edwin Healy’s appeal against a finding that National Car Testing Service Limited (NCTS) had not discriminated against him on age grounds. Its determination was signed on 16 December 2005. Healy said a trainer made remarks about his age during training for a vehicle inspector role and that he was not tested alongside the other trainees. NCTS said he had been warned about his performance, offered extra instruction and failed the final assessment. The Court was not satisfied that the alleged remarks had been made and found no other evidence supporting the claim. It accepted that trainees were assessed using the same process and had an equal opportunity to pass.
