Labour Court finds company discriminated against prospective actress, awards £450

Labour Court ·

In 1991, the Labour Court found that a company discriminated against a prospective employee by withdrawing an offer of work as an actress, and awarded her £450 for lost earnings and distress. The determination was dated 27 September 1991.

The Employment Equality Agency appealed on the worker’s behalf after an Equality Officer found no discrimination. The Court accepted that the interview questions were not discriminatory, but found that the company failed to explain why it withdrew the offer after learning the claimant was married. It held that the company had not rebutted the presumption arising from the evidence, and the appeal succeeded.
