The Labour Court rejected an Employment Equality Agency appeal on behalf of an unnamed worker over promotion, working conditions and training at the Electricity Supply Board. The determination was signed on 16 August 1989. The worker argued that a male engineer with less service had been promoted ahead of her. The Court found seniority was one factor, not the only one, and accepted the employer's evidence that the man was promoted on merit and performance. The Court also rejected the appeals concerning working conditions and access to training, and found no evidence supporting the separate section 2A sex discrimination claim. It upheld the Equality Officer's recommendation that the Board had not discriminated.
