Labour Court declines union request to reinstate Donnelly Mirrors worker

Historic decision · Decision date:

Place: no local area assigned from the source.

The Labour Court did not recommend conceding the Irish Transport And General Workers' Union's request to reinstate a worker dismissed by Donnelly Mirrors Limited. The recommendation was dated 17 August 1989. The company said the worker had been absent from his workstation without permission two days after receiving a final warning. The union argued that the incident had been resolved locally and that he had not been told the absence could lead to discipline. The Court found that the disciplinary process allowed union representation and gave the worker an adequate opportunity to respond. It considered his explanation inadequate and said his absence showed disregard for the procedures and the company's work arrangements.
