In 1993, the Labour Court found that Patricia O’Toole was covered by Job Class 3 under the Women's Clothing and Millinery Employment Regulation Order. The decision was dated 16 April 1993. Five former employees of D.G. Hickey and Company Limited had sought the higher classification, saying they were doing sample makers’ and jumpers’ work while paid the Job Class 5 machinist rate. The Department of Enterprise and Employment said their duties and annual sample work fell within Class 3; the company argued they did not make enough samples to be employed in that class full-time. The Court found no grounds to conclude that any of the other four former employees were covered by Job Class 3.
