The Workplace Relations Commission awarded Iain Slater unpaid gross salary for June, July and August 2022, four days’ holiday pay of €846.15 and €4,230.77 for the failure to provide written employment terms. The correction order, dated 23 August 2023, says it corrects the original decision and should be read with it. It also says Slater’s redundancy complaint was not well founded.
Slater said he worked as Director of Architecture and left on 1 September 2022 because he was not being paid. He said he was underpaid in June and July, received no salary in August, and was also owed holiday pay and an agreed bonus. The respondent did not attend the hearing.
The officer accepted Slater’s payslips and bank statements as evidence of underpayment and awarded gross salary of €4,583.33 per month for June, July and August, less what he had already been paid in June and July. The officer also awarded four weeks’ pay, €4,230.77, because Slater had not received his terms and conditions. The redundancy claim failed because he had not completed the required 104 weeks of continuous employment.
