The Workplace Relations Commission (WRC) awarded Dawn Kelly €1,579.48 for not receiving written employment terms, €550 for insufficient daily rest and €300 for missed rest breaks. It disallowed her redundancy appeal and found a separate public-holiday complaint outside its jurisdiction. A further complaint about payslips was not well founded. The decision was dated 29 July 2026. Kelly said she had worked for Patrick Finlay t/a Slí Beatha Floathouse since 2020 and was put on lay-off when work was still available. Finlay said business was quiet and the arrangements were temporary. The adjudicator found that his counter-notice met the statutory test for expected work resumption, so Kelly was not entitled to a redundancy payment. The WRC found the employer had breached the requirement to provide a written statement of employment terms, which Kelly received in December 2025. It also upheld her daily-rest complaint after the employer did not provide records showing she had received the required rest. The rest-break complaint was upheld because the evidence did not establish that Kelly could take uninterrupted breaks during her shifts.
