The Workplace Relations Commission found that E Fitzgerald Limited T/A Fitzgerald’s Kitchens failed to pay general operative Richard Fagan the applicable construction-sector rate and provide pension access and contributions. Adjudication Officer Breiffni O'Neill awarded €4,000 for those breaches in a decision dated 13 February 2026. The WRC also upheld Fagan’s complaint that holiday pay and his final week’s wages were unpaid, awarding €2,559 in holiday pay and €781 in backpay. Fagan attended the hearing and gave evidence; the respondent did not attend despite notice.
