The Workplace Relations Commission rejected Marcelo Rodrigues Ortega’s race discrimination and harassment complaint against Gather & Gather Ireland Ltd. The decision, dated 5 December 2025, accepted the company’s statutory defence that it took reasonable steps to prevent and address harassment.
Ortega alleged a manager made derogatory comments about his hair and called him “her slave”. The company said it investigated the allegations and referred the manager to disciplinary proceedings, but she left before a formal disciplinary investigation. The adjudication officer found the company followed up promptly and had little else it could practically do after the manager resigned.
