The Workplace Relations Commission awarded Battsetseg Seddavaa €8,000 for unfair dismissal by Beacon Sushi Limited in a decision dated 12 January 2026. The adjudicator found the company dismissed her without giving a reason, holding a meeting, hearing her response or offering an appeal.
Seddavaa told the WRC she was dismissed after suffering a miscarriage. The company said she failed to report absences directly for three scheduled shifts and that it later reinstated her before she resigned. The adjudicator found the company knew about the miscarriage and that relying on technical reporting breaches was unreasonable in the circumstances. She said the company’s procedural failures bore overwhelming responsibility for the dismissal and resulting loss, while also accounting for Seddavaa’s limited job-seeking evidence before she secured temporary work. Her Employment Equality Act and Parental Leave Act complaints were withdrawn; her unfair-dismissal complaint was upheld.
