WRC rejects Treacy O Neill’s constructive dismissal complaint

The Workplace Relations Commission found that Treacy O Neill was not unfairly dismissed by The School Food Company after ruling she lacked the one year of service ordinarily required to bring an unfair dismissal complaint. Adjudication Officer Brian Dolan dated the decision 31 October 2025; the merits of her constructive dismissal allegation were not determined. O Neill had about seven months’ service and did not rely on an exemption to the service requirement. The company argued she lacked the required service, while saying it was prepared to defend the complaint on its merits if necessary. No monetary award was recorded.
