The Workplace Relations Commission found that a worker was unfairly dismissed during probation and directed a health service provider to pay her €21,153.50, about 20 weeks’ wages. The decision was dated 6 February 2026.
The worker said her dismissal followed her report that a colleague may have breached sick-leave procedures and was linked to her return from maternity leave. The provider denied the complaint and said her performance had fallen short. The WRC found insufficient evidence that either matter caused the dismissal; it also found the alleged pregnancy-related comments were uncorroborated.
The WRC found the appeal did not fully review the worker’s concerns and gave little reasoning, so the probation procedures were inadequate at that stage. The worker claimed €42,307 in actual and prospective losses. The award was reduced by 50% because she had not taken sufficient steps to mitigate her loss; she had obtained part-time work in August 2025.
