The Workplace Relations Commission dismissed two age discrimination claims brought by Brendan Coone against Bus Eireann, finding them anticipatory and misconceived. Adjudication Officer Patsy Doyle dated the decision December 16, 2025. The dismissal did not decide whether the age limit was discriminatory.
Coone, who drove a school bus for a contractor, sought to continue driving beyond age 70. Bus Eireann said its policy barred drivers over 70 for medical risk management. The officer found Coone was not Bus Eireann’s employee and could not rely on employee protections or the collective agreement. She also raised concern about a lack of transparency over a policy clearly setting out the age limit.
