WRC rejects shop assistant’s discrimination and harassment claims

By Aoife Loughran

Historic decision · Decision date:

Place: no local area assigned from the source.

The WRC found that a shop assistant was not discriminated against or harassed on grounds of gender or disability. The decision was dated 5 September 2025.

The assistant said a manager referred to him as autistic during a phone call and had previously asked whether he was autistic. He also claimed he was treated less favourably because he was the only male shop employee apart from the owner. The respondent denied discrimination and said the assistant was dismissed during probation after repeated mistakes, including a €100 cash-back loss.

The adjudication officer found no less favourable treatment or harassment on gender grounds. The assistant said he had not disclosed a disability to the respondent and that his claim concerned a disability attributed to him by a manager. The officer also found no less favourable treatment or harassment on the disability ground, including an imputed disability. The claims were rejected on their merits.
