Ashlinn Cummins’s constructive dismissal complaint against The James Aesthetic Clinic Limited was rejected by the Workplace Relations Commission, which found she was not unfairly dismissed. No compensation was awarded.
In a decision dated 28 October 2025, Adjudication Officer Michael MacNamee accepted that Cummins raised serious workplace concerns which led her to resign. But her contract referred to the clinic’s grievance procedure, and she did not submit a written grievance before resigning. The adjudicator found no exceptional circumstances excusing that failure.
Cummins alleged bullying, patient safety and administrative problems, poor conditions and contractual issues. The clinic denied that these justified her resignation and said she had not used its grievance procedure.
