WRC cannot hear Breda Wimsey’s discrimination complaint against Abbvie

The Workplace Relations Commission could not hear Breda Wimsey’s disability discrimination complaint because it was brought against the wrong legal entity. The decision was dated 11 December 2025. The merits of her allegation were not decided. Wimsey asked to replace Abbvie with Abbvie NL B.V., arguing that the name error was technical and the substance of the complaint would remain unchanged. The respondent opposed the request, saying the correct employer name appeared in her employment documents and the WRC had no power to substitute the party. The adjudication officer found that the Employment Equality Act allowed correction of errors in a decision or determination, but did not give the WRC power to replace a respondent named in a complaint. The complaint therefore ended on that preliminary legal-entity issue.
