WRC rejects bartender’s discrimination and notice claims

By Aoife Loughran

The WRC rejected a bartender/waiter’s complaints of age and disability discrimination, failure to provide training, victimisation and failure to provide reasonable accommodation. In a decision dated 15 May 2026, it also found his minimum-notice complaint was not well founded. The worker said the owner and head chef shouted at him and that he was dismissed after objecting. He said he had informed the owner of his conditions. The bar disputed his account, saying it had issued two written warnings for performance and conduct issues and had not been told of a disability. The adjudicator found no prima facie case of discrimination on age or disability grounds and insufficient evidence of a failure to provide reasonable accommodation. The notice complaint failed because his service was under 13 weeks.
