WRC awards Santa Musinska €8,000 for discriminatory dismissal

The Workplace Relations Commission awarded Santa Musinska €8,000 after finding that Oak Central Recruitment Services Limited dismissed her because of her disability. In a decision dated 6 November 2025, the WRC also awarded her €5,000 for discrimination involving a failure to provide reasonable accommodation.

Musinska worked as a picker. She told the WRC that allergic eczema affected her hands, that the gloves provided did not stop her condition worsening, and that the company did not move her to another picking area. The company said business volumes fell after Christmas and it selected its most recently hired worker for dismissal.

The adjudication officer found the eczema amounted to a disability and that the company knew about it. Although gloves were available, the company did not carry out a risk assessment or refer Musinska for an occupational health review despite her absences. The officer rejected the company’s seasonal work and probation explanations and found that the dismissal was because of her disability. Her two agency-worker complaints and her victimisation complaint were not well-founded.
