The Workplace Relations Commission rejected two age discrimination complaints by Eugene McEnery against Partners In Logistics Ltd, finding no discrimination over his retirement or pay. The decision was dated 12 February 2025.

McEnery said his employment ended after he declined a proposed three-day week beyond the company’s stated retirement age of 65. The company said that age was set by contract and justified by legitimate aims. The adjudication officer accepted that the retirement age was contractually set and objectively justified, while noting McEnery should have had access to a proper appeal process.

The officer also rejected McEnery’s complaint that colleagues’ pay increases amounted to discrimination. The company said those increases brought colleagues to €12.70 an hour, while McEnery was already paid €12.96. No compensation was awarded.
