Mary Gilligan’s redundancy complaint against Merit Epos Systems dismissed as out of time

The WRC found it had no jurisdiction to hear Mary Gilligan’s redundancy complaint against Merit Epos Systems Ltd Jbm/Merit because she lodged it outside the time limit and did not establish reasonable cause for an extension. The decision was dated 9 September 2024. The merits of her redundancy entitlement were not decided. Gilligan said she was made redundant when the company was liquidated in August 2022. The liquidator said she transferred to a new company. The adjudication officer found that processing delays did not justify the delay in referring the complaint, almost one year and nine months after her employment ended.
