The Workplace Relations Commission has directed Go-Ahead Ireland Bus Limited to pay Noel Kelly €13,000 after finding the company unlawfully withheld wages. The decision was dated May 8, 2025.
Kelly said he was fit to work but had been stood down while awaiting occupational health clearance; the company said he lacked medical clearance and had received all sick pay due under its scheme. The WRC found he was absent on the employer’s instructions while an assessment remained pending, so his wages were payable. It accepted that bus driving was safety-critical but found the company and its occupational health consultant should have pursued the assessment more actively.
