WRC rejects home care worker’s constructive dismissal complaint

The Workplace Relations Commission rejected Sharon Devine’s constructive unfair dismissal complaint against Ann's Homecare & Danu Homecare, finding that her resignation was not a constructive dismissal. The decision was dated 31 March 2025. Devine said reduced hours, a lack of consultation and the employer’s response to her grievance left her no choice but to resign. The employer said changes to its HSE contract reduced available work and required staff hours to be cut. The adjudicator found no fundamental breach and said the hours change was externally imposed.
