WRC rejects former JMC Packaging manager’s unfair dismissal claim

A Workplace Relations Commission adjudication officer rejected Jason Govender’s unfair dismissal claim against Jmc Packaging Limited, finding that he resigned. The decision was dated 26 September 2024. Govender said he tried to withdraw his resignation after family bereavements and stress, and believed it had been rescinded. The WRC found the resignation was clear and that he had not been dismissed. His minimum notice and working-time complaints also failed; the WRC found he was not in the workplace during the period relevant to the working-time complaint.
