The Workplace Relations Commission found the dismissal of Neil Molloy, a breakfast show presenter at Galway Bay FM, was not unfair. Its decision was dated 6 November 2024. Molloy challenged the severity of his dismissal for serious misconduct and argued that advertising involving his role suggested the outcome was predetermined. The station said an independent investigation upheld two complaints about incidents involving its CEO, followed by disciplinary and appeal processes. The adjudicator raised serious concerns about the CEO’s central role in the complaints, suspension and publicity surrounding the process, and found that a gross-misconduct finding was excessive. However, the adjudicator found the dismissal itself was not unfair. The minimum-notice complaint was also not well founded, and Molloy’s separate terms-of-employment complaint was withdrawn after the statement of terms was provided.
