The Labour Court dismissed Declan Duffy’s appeal against the finding that his constructive dismissal complaint against Forte Healthcare Ltd was not well founded. The decision is dated 5 November 2024, and the Court affirmed the Adjudication Officer’s ruling. No award was recorded. Duffy said problems with his company car, a performance improvement plan and his exclusion from a September conference left him no option but to resign. Forte said it had tried to engage with him and that he resigned without using internal procedures. The Court found no unreasonable conduct in the employer’s handling of the car concerns or the plan. It described the conference communication as poor, but noted Duffy was on certified sick leave when it was held. It also found he had not pursued his grievance through workplace procedures before resigning.
