The Workplace Relations Commission found that Mugshot Cafe Ayrfield Limited did not breach transfer of undertakings rules in its case with former employee Olive Dalton. The decision, dated 16 July 2024, said Dalton had not shown that she was retained on less favourable terms after the transfer. Dalton said she received no information about the sale or written terms and conditions, and resigned after seeking a contract. The company said it was arranging a contract and wanted her to stay. The adjudicator accepted that explanation and found it unreasonable for Dalton to resign without allowing time for the contract to be finalised.
