The Workplace Relations Commission found Yvonne Quigley’s constructive dismissal complaint against United Drug was not well founded. Adjudication Officer Catherine Byrne issued the decision dated 11 July 2024. Quigley said she resigned after her relationship with her team leader deteriorated and the sales manager failed to address her concerns. United Drug argued she had not used its grievance or bullying procedures before resigning. The WRC found the evidence did not show that the team leader’s conduct was so unreasonable Quigley had to resign. It also found Quigley acted unreasonably by not seeking help from HR or using the company’s procedures. Constructive dismissal is when an employee resigns in circumstances where the employer’s conduct makes the resignation legally a dismissal.
