The Workplace Relations Commission found Frank O'Donnell’s complaint against Letterkenny University Hospital was not well founded. The decision, dated 12 July 2024, concerned annual leave and public holiday entitlements during periods of cocooning and sick leave.
O'Donnell said he was owed accumulated leave and public holiday pay. The hospital said leave accrued during cocooning was allocated within the leave year and that most sick leave accrual had been paid. The adjudicator found no basis for additional annual leave during cocooning while O'Donnell remained paid and had no assigned work, and accepted that sick leave accrual had been paid apart from unauthorised absences. The hospital had committed to paying 15.4 hours of outstanding public holiday entitlement.
