Tesco ordered to re-engage worker and pay €2,500 over family-status discrimination

The Workplace Relations Commission found that Tesco Ireland Limited indirectly discriminated against Courtney Carter on family-status grounds and ordered it to re-engage her and pay €2,500 compensation. The decision, dated 5 July 2024, also requires a further 13 weeks of probation.

Carter’s absences during her probation included time caring for her sick child. Tesco applied the same attendance rule to sickness absence and absence to care for a sick dependent. The WRC found this placed Carter at a disadvantage, and that Tesco had provided no objective reasons for the policy.
