The Workplace Relations Commission rejected Damien Wade’s unfair dismissal complaint against Gravity Construction Ltd., finding that he had not been dismissed. In a decision dated 16 April 2026, adjudicator Gaye Cunningham said the company’s repeated requests for Wade to return to work weighed against his claim that it had ended his employment.
Wade alleged that Gravity dismissed him after he raised concerns about asbestos removal practices and workplace safety. Gravity denied dismissing him and said he left voluntarily, remained employed and was invited to return and use its grievance process. The adjudicator considered their conflicting accounts of a heated discussion and found the complaint not well-founded; the decision does not establish that Gravity breached safety rules.
