WRC finds Michael Carolan was not entitled to statutory redundancy pay

The Workplace Relations Commission found Michael Carolan was not entitled to statutory redundancy pay after deciding he had not been dismissed by Fmi Ltd. Its decision, dated 9 April 2024, found that the alternative assignments offered to him were reasonable and consistent with his contract. Carolan’s merchandising role was put at risk after the supermarket where he worked brought the dry-goods work in-house. He said the alternative roles were unsuitable because of cold-room conditions and travel distance. Fmi Ltd said he remained employed and that the roles were reasonable. The WRC found that Carolan had declined the assignments without giving a reason consistent with his contractual obligations. It therefore found his complaint not well founded. The claim concerned statutory redundancy pay, which is payable when the legal conditions for redundancy are met, including a dismissal by reason of redundancy.
