The Workplace Relations Commission found Szymon Gasiorowski’s unfair dismissal and minimum notice complaints against Super Valu were not well founded. The decision, dated 6 September 2024, said the dismissal was for gross misconduct and the minimum notice complaint therefore failed. Two other complaints were withdrawn. Gasiorowski, a sales assistant, challenged his dismissal after more than 12 years’ service, arguing that procedures were unfair and dismissal was disproportionate. Super Valu said it had followed its procedures and that accumulated misconduct justified dismissal. The adjudicator found that a full and fair process had been followed, with no major procedural shortcomings, and concluded the dismissal fell within the reasonable range for a supermarket employer. The working-time and payment-of-wages complaints were withdrawn at the hearing.
