The Workplace Relations Commission found Andrew Gordon's constructive dismissal complaint against Kbc Bank Ireland not well founded. The decision was dated 12 February 2024. Gordon joined the bank as a senior insurance underwriter in October 2020. After it announced plans to leave the Irish market, his role shifted to pensions wind-down and transfer work, an area outside his expertise. He said the change amounted to constructive dismissal. Gordon resigned on 28 April 2023 after securing another job. He expected to be made redundant in late June and sought an enhanced redundancy payment, which the bank refused. The adjudicator found that his resignation was prompted by impending redundancy, not the change in role, and that the unpaid redundancy sum followed from his resignation. For constructive dismissal, he had to show that his resignation was reasonable and caused by unreasonable conduct by the bank.
