WRC rejects Mindaugas Uoka's transfer-of-undertakings complaint

The Workplace Relations Commission found that Sharp Group Fire & Security Services did not breach transfer-of-undertakings rules in its treatment of security officer Mindaugas Uoka. The decision was dated 5 April 2024. Uoka said his work location, shifts, duties and pay arrangements changed after he transferred to Sharp Group in June 2023, leaving him on less favourable terms. The company said the move was within the same building, his pay had increased and a manual-handling course was needed for heavier deliveries. The adjudicator found that Uoka's role and responsibilities remained substantially the same. He had not shown that the changes breached a fundamental term of his employment contract, and the complaint was not well founded.
