The Workplace Relations Commission rejected Gerard Brennan's Employment Equality Act complaint against the HSE after he was refused a day's bereavement leave following his uncle's death. The decision was dated 5 April 2024.
Brennan, an HSE painter, said other public service employees could receive bereavement leave after the death of an uncle, while HSE policy did not provide it. The HSE said it applied its own policy, which did not cover an uncle's death.
The adjudicator said the complaint was not based on any of the nine grounds required for a discrimination claim under the Employment Equality Act. It was therefore misconceived under the Act and not well founded.
