WRC dismisses Martin Harkins's late redundancy claim

The Workplace Relations Commission dismissed Martin Harkins's redundancy payment claim against Thomas Foley Painting Contractor Limited as out of time. The decision was dated 20 March 2024; the merits were not decided. Harkins said he was owed redundancy pay after the company ceased trading and that delays involving his former representative explained the late referral. The employer disputed that there was a redundancy situation and also argued the claim was late. The WRC found the first claim was referred about eight months after the 52-week limit and that there was no reasonable cause to extend it. A second claim was disallowed as a duplicate.
