A Workplace Relations Commission adjudication officer found a former sales manager’s complaint against Cognito Hrm ltd not well founded. The decision, dated 6 March 2024, concerned claims for unpaid commission, annual leave and notice pay. Shane Beere claimed €1,800 in commission, €1,120 in annual leave pay and €640 for notice. The company disputed the claims, arguing that commission depended on customer payment and did not survive the end of his employment. The officer found three days of outstanding annual leave had been paid and that Beere had worked and been paid for his four-week notice period. The commission was not declared during his employment and was barred by a clause for employees who leave before it becomes payable. The officer found none of the claimed amounts was properly payable, so the complaint was not well founded.
