The Workplace Relations Commission awarded Daryl Malone €5,000 after finding that Southside Barber Limited (In Liquidation) unfairly dismissed him. In a decision dated 17 May 2024, it also awarded him €1,668 for late employment terms and €500 for underpaid and unpaid wages.
Malone told the WRC he was dismissed by text after becoming unwell and was not given a chance to respond to allegations or challenge the decision. The company did not attend the hearing or submit a defence. The adjudication officer found that the reason for dismissal remained unclear and that the company had not followed a formal disciplinary process. In plain terms, unfair dismissal means the employer did not show adequate grounds or act fairly in ending the employment.
The WRC also found that Malone received his written terms late and that they did not identify the employer’s legal name. It found two duplicate complaints not well founded. The decision says Malone found alternative work shortly after his dismissal.
