WRC rejects estate agent’s unfair dismissal complaint

The Workplace Relations Commission rejected Barry O'Brien Lynch’s unfair dismissal complaint against Es Reilly Estates Ltd trading as Sherry Fitzgerald Reilly, finding he had resigned. Adjudication Officer David James Murphy’s decision was dated 24 March 2025. O'Brien Lynch said he was summarily dismissed after a disagreement. The company maintained he had resigned. The adjudicator found he had stopped working before the meeting at which he said he was dismissed and had handed in his equipment; on the balance of probabilities, he resigned and was not dismissed.
