Burke said she was not rostered after returning from sick leave and resigned after seeking advice. The employer argued she left voluntarily and disputed that she was a manager or had guaranteed hours. The adjudication officer found her contract identified her as a manager and that she had average hours of at least 40 a week. The officer found she had no option but to resign after the employer repudiated her contract. Burke was out of work for four weeks, and the award matched four weeks’ wages.
