WRC rejects hospital worker’s claim for lost premium payments

The WRC found no merit in a hospital worker’s claim for premium payments he lost while unable to return from long-term sick leave. Adjudication Officer Seamus Clinton dated the recommendation 19 January 2024. The worker said the hospital had not made enough effort to find suitable alternative work. The employer relied on circulars and occupational health advice. Clinton found no evidence that the employer had been tardy or negligent in facilitating a safe return. He said remote work would be unlikely to attract premium payments and that the circulars made no provision for them.
