The Workplace Relations Commission found for David Tynan in redundancy, annual-leave and minimum-notice complaints against Cribbin Family Butchers Limited (in liquidation), ordering compensation equal to 5.5 days’ pay and eight weeks’ pay in lieu of notice. The redundancy payment for earlier service is conditional on his employment being insurable for the relevant purpose. The company ceased trading in November 2022 and had already paid redundancy for part of Tynan’s service. The WRC allowed his appeal for service from 12 November 2007 to 15 January 2015, based on a gross weekly wage of €600. The officer found 5.5 days of annual leave remained unpaid, rather than the 15 days Tynan had originally claimed, and ordered compensation equal to those days’ pay. With more than 15 years’ service, he was entitled to eight weeks’ notice. The decision was dated 17 January 2024.
