The Workplace Relations Commission found a complaint by Nicholas Glynn against the Health Service Executive was not well founded, after he challenged a €322.99 deduction from his pay. The decision was dated 31 January 2024. Glynn said the HSE deducted the money without consulting him or explaining why. The HSE argued that overtime was not properly payable to him as a Grade VIII employee and that recovering an overpayment fell outside the relevant restriction in the Payment of Wages Act. The adjudicator found Glynn’s overtime was not properly payable and the deduction related to reimbursement of an overpayment, which was outside the Act’s scope. The complaint failed.
