The Workplace Relations Commission ordered HSE Rcsi Hospital to pay Robyn Poole €1,076.50 for unpaid sick-pay compensation and €5,000 for disability discrimination and failure to provide reasonable accommodation. The decision, dated 27 February 2025, found the hospital had not arranged an occupational health review before her emergency department rotation.
The adjudicator upheld both complaints. Poole said she had not received her full sick-leave benefits; the hospital said outstanding sick leave had been paid and sought to withdraw the complaints. The adjudicator found her wage evidence was undisputed and that the hospital had failed to provide the review, although it later found her alternative work.
