The Workplace Relations Commission found Fiona Bennett (Nee Mcgrath)’s minimum notice and redundancy complaints against Boody's Chipper well founded in a decision dated 27 September 2023. It awarded her €378 for minimum notice and found she was entitled to a redundancy payment based on her employment details. Bennett said her role ended when the business closed on 30 September 2022, and she received neither redundancy pay nor minimum notice pay. The respondent did not attend the hearing, but had emailed that it was arranging payment and needed her bank details. The adjudication officer found that Bennett was entitled to two weeks’ notice and that she had been paid below the 2022 minimum wage. She had been paid €10.20 an hour, while the statutory minimum was €10.50. The officer awarded €378 for the notice complaint and found her redundancy complaint well founded, awarding her the redundancy payment calculated from her listed employment details.
